If this was a civil case, she had a very valid case. You should only pay for actual damages incurred, including loss of value or painting etc. But this was a criminal proceeding and the restitution is set in stone. That's the amount the court decided, that's what you pay. If the actual damages were 10000, the judge could have done 10000 as restitution and a 40000 fine. The end result is the same. The judge took the total amount into consideration in setting her sentence and fines.
